Adjustments to the terms and conditions for bookings in 2021

Special cancellation right in case of Corona / COVID-19

If the customer can not travel due to Corona / COVID-19, the following regulations will apply:

  • Free cancellation / rebooking is possible up to 30 days before departure. For cancellations / rebookings within a period of less than 30 days before departure our general terms and conditions apply:

– from the 29th to the 15th day before departure 30 %
– from the 14th to the 8th day before departure 50 %
– from the 7th day before departure 75 %
– 90 % on the day of departure and in case of no-show

  • In the event of a general travel ban to Colombia in the home country of the customer, the customer has the right to cancel or rebook the trip free of charge up to the day of departure. Deposits and payments received from the customer will be fully reimbursed.

Conclusion of the Travel Contract
Based on the booking request, ECC Radsportreisen (hereinafter referred to as “ECC”) creates an individual offer for the customer. With the acceptance of the offer by the customer, which can take place in writing, orally, by telephone or electronically (Internet/E-Mail), the booking becomes binding. The travel contract is concluded based on the description of the journey as well as these general terms and conditions.

After conclusion of the contract and receipt of the booking confirmation, a deposit of at least 20 % of the travel price is due. The final payment must be made in full and unsolicited, no later than 28 days before the start of the journey, if it is clear that the journey will take place and can no longer be canceled for the reasons stated in Section 7.1. In case of journeys where the travel date is less than 28 days in the future, the entire travel price must be paid immediately. If the due travel price is not paid despite a reminder and a reasonable deadline, ECC is entitled to withdraw from the contract and to charge the customer with the cancellation costs listed in Section 5.1.

ECC meets the credit criteria of R+V Allgemeine Versicherung AG, Wiesbaden. All payments are insured and protected in accordance with German/European law at R+V Insurances. The customer receives the corresponding certificate together with the travel documents.

Withdrawal by the customer, rebooking, replacement of persons
The customer can withdraw from the trip at any time prior to departure. Decisive is the receipt of the declaration of withdrawal at ECC. The withdrawal should be declared in writing. If the customer withdraws from the travel contract, ECC may demand a reasonable compensation for expenses and travel arrangements made. The amount of the compensation shall be based on the travel price minus the value of the expenses usually saved by ECC and what ECC may acquire through the alternative use of the travel services. ECC can calculate this claim specifically or as a lump sum. Lump-sum compensation (as a percentage of the travel price) can be charged as follows:

– until the 30th day before departure 20%
– from the 29th to the 15th day before departure 30%
– from the 14th to the 8th day before departure 50%
– from the 7th day before departure 75%
– 90% on the day of departure and in case of no-show

Rebooking is only possible in the cases specified in the complete Terms and Conditions and under the conditions described there.

Resignation and termination by ECC
ECC may withdraw from the travel contract if the minimum number of participants (MNP) is not reached, if it has explicitly named and quantified the MNP in the respective description of the journey and specified the time at which the traveler must have received the ECCs declaration prior to commencement of the journey. Furthermore the Travel Confirmation must indicate the MNP and the latest cancellation date refering to the corresponding description of the journey. A withdrawal by ECC must be declared to the customer no later than 28 days prior to the start of the journey. Payments that already have been made will be refunded to the customer immediately.

If the realization of the journey is made considerably more difficult, endangered or influenced as a result of force majeure, both ECC and the customer may terminate the contract. The legal consequences are those as decribed in German law (§ 651j BGB, § 651e Paragraph 3 S. 1 and 2, Paragraph 4 S. 1 BGB). According to German law, ECC may claim reasonable compensation for services provided or to be provided.

Travel Insurance
There is no insurance of any kind provided by ECC, neither against accident nor against illness. The customer should have a good travel insurance that covers all possible risks, in particular travel cancellation costs, illness and accidents.

In addition to the regulations of these terms and conditions, please note that we always endeavor to act as unbureaucratically as possible and in the interests of our guests. In case of any incident we try to find a fair solution which is satisfactory for all parties involved.
